Terms of Service

Customer: 

The customer retains the rights to their character and to post, use, and advertise with the art commissioned by me. If the art is posed on a public space (i.e. twitter, instagram, mastodon) I require to be credited as the artist unless otherwise discussed. 

The customer DOES NOT retain the right to change or alter art I make. If they desire a change or alteration they must have it done via me and be charged accordingly if necessary.

The customer (or other entity) DOES NOT retain the rights to make my art an NFT or use it in any related way.

The customer DOES NOT have the right to sell my work without a previous agreement and proper compensation and credit. 

The customer DOES NOT have the right to use my work they commissioned for any purpose concerning data training for machine learning or artificial intelligence models. 

The customer retains the right to request a refund (full or in part) at any point before labor has been maid on their order. Following any labor the client still has the right to request a refund, but will still have to pay off the difference in the hours of labor times $15. All refunds will be paid via Venmo, cash app, or in cash. 

 

Artist:

I retain the copyrights to the art commissioned from me in so far as I can use the works for advertising, promotional, portfolio, or personal reasons.

 

I retain the wrights to all art I make to post/share in public spaces like events or social media. If do not own the characters in an artwork I do no gain wrights to them by being commissioned to work on them. I only have rights to the work itself.

 

I retain the wright to improve or add additional effort to commissions without increasing the agreed price. 

 

I retain the right to remove art commissioned from me from public spaces. If I post my work or if a customer (or other entity) posts my work I retain the right to have it taken down/removed.

I retain the right up update or change any aspect of my TOS to better serve my customers and protect myself, and my work. 

General:

My work is to never be used for advertising, NFTs, Ai, sales, products, or any purpose other than I have given clear and specific consent to. Even then, I must be credited alongside my work.





 

Frequently Asked Questions

I aim to deliver pieces within 1 month of order. However, life likes to throw curve balls at me, and I will be very communicative when it does.

 

Q) How do you go about ordering a commission from Luca?
A) Commission Process: 
    #1) Send me an email, detailing out what you are interested in me illustrating for you. Then, I'll give you a quote and an estimated delivery time.  

    #2) We agree on a price and you pay via email invoice or other mutually agreed payment system. Payments are accepted up front, unless otherwise agreed upon.

    #3) I give regular updates to progress once I have started on your piece.


Q): Can you tip Luca for His work?

A): Tipping me is neither required nor expected. But if you happen to do so, it is greatly appreciated.

Q) Why does Luca's price sheet offer a different price than what he quoted to you?

A) Likely, your order was either more complex or less complex than what he regularly invests in a commission of its category. Commission prices are based on average time spent, multiplied by the wage he aims to be paid, which at the moment is between $10-$15 an hour. So, if your piece is complex it may take more time and therefore he will have to charge more.

Q) What if you want Luca to change something about the artwork you got?

A) If you want a change done *Before* the art is delivered, so long as its not to far into the process (inks, major shading, etc) you can just let him know and Luca will change it. Free of cost. But if you want something changed *After* he has completed the work, or if he's too deep into the process, he will require payment. This extra cost will be determined by the scale of the edit. Prices may range from $20-$100 (i.e. making a few edits to a figure, changing colors on items, small linework edits would be small, but scene altering changes or pose re-works would cost much more).
